​Terms of Service –​ Liberty Virtual Courtroom

Effective Date: March 25, 2026
These Terms of Service (“Terms”) govern access to and use of the Liberty Virtual Courtroom platform (“LVC” or the “Service”), provided by High Criteria, Inc. (“HCI,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms.


1. Definitions
1.1 “Customer”
Refers to the organization that licenses, deploys, and administers the Service, including courts, government agencies, municipalities, law enforcement organizations, or other authorized entities.

1.2 “Participant”
Refers to any individual who accesses or interacts with the Service at the direction of a Customer, including but not limited to attorneys, litigants, witnesses, observers, jurors, or members of the public.

1.3 “Service”
Refers to the Liberty Virtual Courtroom platform and related software, applications, and components provided by HCI.


2. Scope of Service
2.1 The Service is a virtual conferencing and recording platform designed to support court proceedings, hearings, and related workflows.
2.2 HCI licenses the Service to Customers. Participants are granted access solely at the direction of the Customer and for purposes authorized by the Customer.


3. Relationship of the Parties
3.1 Customer Responsibilities
The Customer:
  • Controls access to and use of the Service
  • Determines how proceedings are conducted
  • Is responsible for compliance with applicable laws, rules, and policies
  • Owns and controls all recordings and data generated through the Service

3.2 Participant Role
Participants:
  • Access the Service at the direction of the Customer
  • Do not have a direct contractual relationship with HCI
  • May only use the Service for authorized purposes

3.3 HCI Role
HCI provides the technology platform and does not:
  • Act as the system of record for proceedings
  • Control how case-related data is collected, used, or retained
  • Determine the legal or procedural requirements governing Customer use


4. Access and Use
4.1 Access to the Service may be provided without individual user accounts and may include:
  • Invitation links
  • Court-managed access controls
  • Session-based authentication

4.2 Participants are responsible for maintaining the confidentiality of any access credentials provided to them.


5. Acceptable Use
5.1 Users agree not to:
  • Interfere with or disrupt proceedings
  • Attempt to gain unauthorized access to systems or sessions
  • Record, copy, or redistribute proceedings except as permitted by the Customer
  • Use the Service for unlawful, abusive, or disruptive purposes

5.2 The Customer retains full authority to:
  • Admit or remove Participants
  • Mute or restrict Participant activity
  • Control all aspects of the session


6. Recordings and Data
6.1 Ownership
All recordings, metadata, and case-related information are owned and controlled by the Customer.

6.2 Storage Model
The Service operates under a Customer-controlled storage model. Data may be stored:
  • Within Customer infrastructure
  • In Customer-managed cloud environments
  • In Customer-designated storage systems
HCI does not function as a long-term repository of official records.

6.3 Responsibility
The Customer is solely responsible for:
  • Data retention policies
  • Access, disclosure, and distribution of data
  • Compliance with applicable laws and regulations

6.4 Participant Acknowledgment
Participants acknowledge that sessions may be recorded and monitored at the discretion of the Customer.


7. Privacy and Data Handling
7.1 HCI processes limited technical and operational data necessary to operate and secure the Service.

7.2 HCI does not control or determine how case-related data is collected, stored, or used by the Customer.

​7.3 Participants should direct any requests regarding access to or deletion of case-related data to the Customer, not HCI.


8. Third-Party Services
8.1 The Service may rely on or integrate with third-party providers, including:
  • Cloud infrastructure providers
  • Telecommunications or VoIP services
  • Speech-to-text or related technologies

8.2 HCI is not responsible for:
  • The availability or performance of third-party services
  • The data handling practices of third-party providers


9. Service Availability
9.1 HCI will use commercially reasonable efforts to maintain Service availability.

9.2 The Service may be subject to interruptions due to:
  • Maintenance activities
  • Network dependencies
  • Customer infrastructure limitations
  • Third-party services

​9.3 HCI does not guarantee uninterrupted or error-free operation.


10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HCI DISCLAIMS ALL WARRANTIES, INCLUDING:
  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
HCI does not warrant that the Service will meet all Customer requirements or operate without interruption.


11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
HCI SHALL NOT BE LIABLE FOR:
  • INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF DATA, RECORDINGS, OR PROCEEDINGS
  • INTERRUPTIONS CAUSED BY NETWORKS, HARDWARE, OR THIRD PARTIES
HCI’s total liability shall not exceed the amount paid by the Customer for the Service during the preceding twelve (12) months.


12. Indemnification
The Customer agrees to indemnify and hold harmless HCI from any claims arising from:
  • The Customer’s use of the Service
  • Conduct of Participants
  • Failure to comply with applicable laws or regulations


13. Suspension and Termination
13.1 HCI may suspend or terminate access to the Service:
  • If required by law
  • For violations of these Terms
  • At the direction of the Customer (for Participant access)


14. Modifications to Terms
HCI may update these Terms from time to time. Continued use of the Service after such updates constitutes acceptance of the revised Terms.


15. Governing Law
These Terms shall be governed by the laws of Ontario, Canada, without regard to conflict of law principles.
